Terms of Service

PoolControl.ai is an information and documentation tool. It does not supervise aquatic facilities, direct lifeguard activity, or replace certified training, in-person supervision, or the safety standards of any certifying body.
1. The Service
PoolControl.ai ("the Service") provides software for recording lifeguard performance audits, scheduling audit activity, tracking remediation, and generating related documentation and analytics for aquatic facilities ("Clients"). The Service records and organizes information entered by the Client's own authorized personnel.
2. Limitation of Liability
The Service is a record-keeping and decision-support tool. PoolControl.ai assumes no responsibility, financial or legal, for any act or omission occurring at a Client facility, including but not limited to: wrongdoing or negligence by facility staff, personal injury, bodily harm, drowning, or death. Responsibility for aquatic safety, staff supervision, certification compliance, and emergency response rests entirely and exclusively with the Client and its personnel.
Audit scores, schedules, coaching suggestions, and analytics produced by the Service are informational. They do not constitute safety certifications, legal advice, medical advice, or guarantees of staff performance. The Client is solely responsible for all employment, supervision, and operational decisions made with reference to information in the Service.
3. Client Responsibilities
- Maintaining all licenses, certifications, and insurance required to operate an aquatic facility.
- Ensuring staff meet the standards of the applicable certifying body, independent of any score in the Service.
- The accuracy of all data entered into the Service by the Client's personnel.
- Controlling access credentials issued to the Client's staff.
4. Accounts & Access
Access is invitation-only and administered by the Client's designated administrators. Role-based permissions (lifeguard, supervisor, manager) control what each user can see and do. The Client is responsible for assigning roles appropriately and revoking access when staff depart.
5. Records & Retention
Submitted audits are immutable within the Service to preserve their evidentiary integrity. The Client is responsible for retaining records in accordance with applicable federal, state, and local regulations and the standards of its certifying body.
6. Disclaimer of Warranty
The Service is provided "as is" without warranty of any kind, express or implied, including fitness for a particular purpose. PoolControl.ai does not warrant that the Service will be uninterrupted or error-free.
